The Truth About Maritime Bodies and Seafarer Protections


At the center of maritime governance stand three key players: the International Maritime Organization (IMO), the International Labour Organization (ILO), and the Maritime Labour Convention (MLC). These entities set the tone—but not the law. As Adria Notari makes clear, these are guidelines, not guarantees.

Responsibility for enforcement lies with flag states—the countries under which vessels are registered. These states decide how, when, and even if certain protections are legally upheld. But don’t dismiss these guidelines as meaningless. In legal disputes, they often serve as evidence of negligence and shape court outcomes.

“Just because a country hasn’t ratified the MLC doesn’t mean seafarers have no rights,” says Notari. “You may still be protected under broader maritime law.”

Flag States and What They Actually Mean for You


Not all flag states are created equal. Some are bound by international conventions like the MLC; others are not. But legal rights can still apply, depending on where the vessel operates or docks.

For example, the United States hasn’t ratified the MLC, yet it enforces strong maritime protections through other legal channels. That means a yacht flagged outside the MLC system could still be held accountable once it enters U.S. waters—or any port with stricter labor laws.

Four Rights Every Seafarer Should Expect


Regardless of flag or flagrant neglect, some fundamental protections are non-negotiable. These include:

  2. Adequate Room & Board – Vessels are required to provide clean, livable accommodations and proper nutrition for all crew members.

  3. Access to Medical Care – Injured on duty? You’re entitled to medical treatment—regardless of who’s at fault.

  4. Timely Payment of Wages – Delays in pay aren’t just unethical—they may be illegal. You have the right to pursue those funds through legal channels.


How to Take Action When Things Go Wrong


Navigating legal action at sea isn’t simple. Jurisdiction can shift depending on where the vessel is docked or flagged. That’s why it’s critical to seek legal guidance from someone who specializes in maritime law.

“It’s not up to the seafarer to know every law,” Notari emphasizes. “That’s why maritime lawyers exist.”

Understanding who your actual employer is, what your contract covers, and where your rights stand before trouble arises can make all the difference. Port state rules, international conventions, and flag state laws often intersect—creating both loopholes and leverage.
